A treatment error occurs when a dentist deviates from the medical standard and thereby causes damage. This includes incorrect diagnoses, improper treatment, lack of patient information, or hygiene violations.

Immediately request your complete patient file including all X-rays and CBCT data. Document all complaints in writing with dates. Then obtain an independent second opinion.

In Austria, there is generally a limitation period of 3 years from the date you become aware of the damage. For unknown damage, there is an absolute deadline of 30 years. However, act as soon as possible, as evidence becomes harder to secure over time.

Not immediately. First, you can contact the patient advocate of your federal state free of charge. A lawyer only becomes necessary if you want to claim damages or if out-of-court settlement fails.

A complaint to the dental chamber is free of charge. The chamber investigates whether a professional violation has occurred. For damages, a separate civil law procedure is necessary.
